APPLICANT REQUESTS THAT:
His characterization of discharge be upgraded to honorable.

STATEMENT OF FACTS:
On 20 March 2008, the Board considered and denied the
applicants request to upgrade his characterization of discharge
to honorable. A complete copy of the Record of Proceedings is
attached at Exhibit E (with Exhibits A-D).
By letter, dated 2 March 2008, which is essentially a request
for reconsideration, the applicant provides four character
reference letters.
The applicants complete submission, with attachments, is at
Exhibit F.

THE BOARD CONCLUDES THAT:
We have thoroughly reviewed the evidence of record and
considered the weight and relevance of the additional
documentation provided by the applicant. Although we find the
applicants recent submission as new and relevant, we do not
find the evidence presented is sufficient to compel us to
recommend granting the relief sought on the basis of clemency.
As in the Boards earlier determination, based on the available
evidence of record, it appears the discharge was consistent with
the substantive requirements of the discharge regulation and
within the commander's discretionary authority. The applicant
has provided no evidence which would lead us to believe the
characterization of his service was contrary to the provisions
of the governing regulation, unduly harsh, or disproportionate
to the offenses committed. Therefore, in the absence of
evidence to the contrary, we find no basis upon which to
recommend granting the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

On 17 January 1955, following the Judge Advocates finding that the case was legally sufficient, the discharge authority approved the applicants discharge under the provision of AFR 39-17 and directed he be discharged with an undesirable discharge.
